Emergency Alerts Privacy Policy

At Convergent Mobile, Inc., we respect your right to privacy and we understand that users of the Emergency Alerts service (the “Service”) and visitors to the Emergency Alerts webpages (“Site”) need to control the uses of their personal information.  Convergent Mobile, Inc. allows parents who wish to subscribe to the Service to create accounts in order to access emergency school information for themselves, their children and other emergency contacts on mobile telephones and personal digital assistants. The privacy policy below describes the measures taken by us to protect your privacy in connection with your use of the Service and the Site.

WHAT PERSONALLY IDENTIFIABLE INFORMATION DO WE COLLECT, AND WHEN DO WE COLLECT IT?

Registration Information.  In order to use the Service, all subscribers must register and create accounts on the Site. When you register, we ask for the following personally identifiable information:  names of parents, children and emergency contact person; mobile telephone numbers of parents, children and emergency contact person; email addresses of parents; full address of parents; age, grade and gender of children and the name of their schools.  Once you are a registered user you can update your profile and you may elect to provide additional information.

Financial Information.  You will pay for the Service through the PayPal online payment service by accessing your existing PayPal account, establishing a new PayPal account, or simply completing the transaction without registering with PayPal.  PayPal accepts payment through credit and debit cards and other payment sources.  During the payment process on PayPal, you will be asked to submit certain account information for the payment source you select.  All of the financial information you submit will reside with PayPal, not with Convergent Mobile.  PayPal has its own policies concerning the collection and use of the personally identifiable information you submit to PayPal.  Please review those policies under the “Legal Agreements” link at the bottom of each PayPal web page.  Convergent Mobile is not responsible for the security or the privacy of the information you submit to PayPal, including without limitation, the financial information you submit when establishing or using a PayPal account.

IP Address.  An Internet Protocol (“IP”) address is a unique string of numbers that is assigned to your computer by your Internet Service Provider.  Web servers automatically identify your computer by its IP address.  However, the Service will not log or retain IP addresses or any record of your visit to our Site.

Cookies.  A “cookie” is a small data file that can be placed on your hard drive when you visit certain websites.  We             do not use cookies.

HOW DO WE USE YOUR PERSONALLY IDENTIFIABLE INFORMATION?

We only use the personally identifiable information you submit to us to provide the Service as described on our Site. We will not use such personally identifiable information for any other purpose unless we announce such new use in a revised privacy statement posted here.

HOW LONG DO WE RETAIN YOUR PERSONALLY IDENTIFIABLE INFORMATION?

We will retain your personally identifiable information indefinitely.  We currently have no policy for deleting user information from our servers.

WITH WHOM DO WE SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION?

The purpose of the Service is to enable your children’s schools to send you messages in the event of an emergency.  We therefore share your personally identifiable information with school officials at the schools where you have indicated in your registration that your child or children are students.  We have no control over how the school officials safeguard access to your personally identifiable information.

We may also disclose information you provide if required to do so by law or if we have a good faith belief that disclosure is necessary to (1) comply with the law or with legal process served on us; (2) protect and defend our rights or property; or (3) act in an emergency to protect someone’s safety.

As we develop our business, we may buy or sell assets and, depending upon the transaction, your personally identifiable information may be one of the transferred assets.  In the event that we are acquired by another company, your personal information may be part of the assets transferred to the acquiring party.

Other than the foregoing, we will not share your personally identifiable information with any other third parties.

WHAT ARE YOUR OPTIONS TO CONTROL THE USE OF YOUR PERSONALLY IDENTIFIABLE INFORMATION?

We do not currently plan on sharing your personally identifiable information with third parties other than the schools that you indicate you wish to inform you of emergencies through the Service.  We do not currently plan on using your personally identifiable information other than in the course of providing the Service. Your only option to control the use of your personally identifiable information is to discontinue the use of the Service, in which case we will retain but not otherwise use your personally identifiable information indefinitely.

HOW CAN I VIEW AND UPDATE MY PROFILE AND OTHER PERSONALLY IDENTIFIABLE INFORMATION?

You may view and update the information you submitted to us when registering for the Service by logging in to your account through the Emergency Alerts secure login page at [www.convergentmobile.com/InstAware].

WHAT ABOUT CHILDREN’S PERSONALLY IDENTIFIABLE INFORMATION?

Our Site is not intended to be used by children. However, in order to use the Service, parents must tell us their children’s names, mobile phone numbers, age, grade and gender and the names of their schools.  We respect the privacy of parents and children and are committed to complying with the Children’s Online Privacy Protection Act (“COPPA”). By submitting to us personally identifiable information about your children, you are consenting to our use of that information in providing the Service, including sharing that information with the schools where your children are students.

WHAT ELSE SHOULD YOU  KNOW ABOUT YOUR PRIVACY? 

Security.  We have security measures in place to protect against the loss, misuse and alteration of the information under our control.  These security measures include locating the servers containing the personally identifiable information you submit to us in the facilities of a third party vendor who is contracted to maintain those servers in a secure environment. That secure environment includes a firewall to prevent unauthorized access to our data as well as twenty-four hour physical security of the vendor’s facilities.  The login procedure for obtaining access to your account and the personally identifiable information you submit consists of a user name and password.  The password is encrypted using the MD5 encryption standard.  Although we will exercise reasonable care in providing secure transmission of information between your computer and our servers, we cannot ensure or warrant the security of any information transmitted to us over the Internet and we accept no liability for any unintentional disclosure.

Links to Other Sites.  Our Site does not contain hyperlinks and pointers to Internet sites maintained by third parties other than PayPal.  We will revise this policy if we begin to provide links to third party websites.

CHANGES TO THIS PRIVACY POLICY

We may make changes in our privacy policy from time to time.  When we do so, we will post the revised privacy policy on our Site with a link at the bottom of our Alerts home page. Our Alerts home page will also contain a statement notifying readers that the policy has changed and the effective date of that change.

Your use of our Site and the Service, including any dispute concerning privacy, is subject to this privacy policy.  We reserve the right to modify this privacy policy at any time by posting the changes on this page.  Please check the revision date at the bottom of this page to determine if the policy has been modified since you last reviewed it.  Your continued use of any portion of our Site and the Service following posting of the updated privacy policy will constitute your acceptance of the changes.
